Buying Terms and Conditions
Terms for purchasing a device from Mozillion.
These Terms
1.1 What these terms cover. These are the terms and conditions by which you can purchase devices, namely mobile phones, through our website. The term ‘device’ in these terms and conditions refer to mobile phones, but may in time include other devices, such as tablet computers and smart watches.
1.2 Why you should read them. Please read these terms carefully before you proceed to purchase a device through our site. These terms tell you who we are, how we facilitate the purchase of your device, how you and we may change or end the contract, what to do if there is a problem and other important information. If you think that there is a mistake in these terms, please contact us to discuss.
1.3 Are you a business customer or a consumer? In some areas you will have different rights under these terms depending on whether you are a business or consumer. You are a consumer if:
- You are an individual.
- You are buying a device through our site wholly or mainly for your personal use (not for use in connection with your trade, business, craft or profession).
1.4 If you are a business customer this is our entire agreement with you. If you are a business customer these terms constitute the entire agreement between us in relation to your purchase. You acknowledge that you have not relied on any statement, promise, representation, assurance or warranty made or given by or on behalf of us which is not set out in these terms and that you shall have no claim for innocent or negligent misrepresentation or negligent misstatement based on any statement in this agreement.
Information About Us and How to Contact Us
2.1 Who we are. We are Mozillion Limited a company registered in England and Wales. Our company registration number is 11864919 and our registered office is at Mozillion, 15 West Street, Brighton, England, BN1 2RL. Our registered VAT number is 347533194
2.2 How to contact us. The quickest way to contact us is by email. You can contact us by telephoning our customer service team or by emailing us at [email protected].
2.3 How we may contact you. If we have to contact you we will do so by telephone or by writing to you at the email address or postal address you provided to us when you created your Mozillion account.
2.4 "Writing" includes emails. When we use the words "writing" or "written" in these terms, this includes emails.
Our Contract With You
3.1 How we will accept your purchase. Our acceptance of your purchase will take place when we email you to confirm it, at which point a contract will come into existence between you and us.
3.2 If we cannot accept your purchase. If we are unable to accept your purchase for any reason, we will inform you of this by email. However, where we have been unable to accept your purchase, we will either provide you with a refund or fulfil your purchase with an alternative product if you agree to this. We will always let you know if this is the case.
3.3 Your order number. We will assign an order number to your purchase when your purchase is confirmed and tell you what this is once your order to purchase a device has been accepted. It will help us if you can tell us the order number whenever you contact us about your order.
3.4 You can only use Mozillion in the UK. Our website platform is solely for the promotion and sale of products in the UK. Unfortunately, we do not accept orders from addresses outside the UK.
Accounts
4.1 Mozillion Accounts. In order to purchase, you must have registered and signed up for a Mozillion account. We will not accept any offers to purchase from any individual or company that does not have a Mozillion account. To register you must provide your real name, address, phone number, email address and a valid UK credit or debit card acceptable by us. You confirm that the information you provide during the registration process (and any notification of change of such information) is true and correct.
4.2 Security. You are solely responsible in all respects for all use of and for protecting the confidentiality of any email verification number and password which may be given to or selected by you for use on our website. You may not share these with or transfer them to any third parties. You must immediately notify us of any unauthorised use of them or any other breach of security regarding our Mozillion account.
4.3 You must be issued with a major UK credit/debit card that is accepted on our website and you must register that card with us, and your application for registration must otherwise be acceptable to us in our absolute discretion. Payments will me made using our current payment processing partners.
4.4 Terms of Use. When signing up for a Mozillion account, you agree to comply with our Terms of Use for the platform generally. We reserve the right to remove your account at any time.
PURCHASING FROM MOZILLION – GENERAL INFORMATION
5.1 Who you’re purchasing from. Mozillion lists devices available for purchase and you are purchasing from Mozillion Limited. You will only be able to see what device is for sale, its price, as well as the model, colour, capacity, network and condition of the device.
5.2 Information you provide. You grant us a non-exclusive, UK , irrevocable, royalty-free licence to use any information you provide to us or other users of our services, for the length of the warranty period offered by Mozillion , for example during the registration or listing process.
5.3 Device Condition. A description of the device description will be provided on each individual listing. We categorise the condition of each device based on the following categories: -
‘Brand New’: This is a brand new phone that has never been used and is in its original sealed box, complete with all accessories.
‘Good As New’: Fabulous.
- Hard to believe it's not brand new
- No cosmetic marks, scuffs, scratches, cracks or dents
- Fully functional, powers on and works as expected
- Original manufacturer parts, no third-party replacement parts
- Original box and accessories included
- Battery health 95% minimum
- Original software that has not been modified or jail broken
‘Excellent’:
- Minimal cosmetic marks, but definitely no cracks or dents
- Any light scratches/marks on the screen are not visible at arm’s length
- Any light scratches/marks on the phone housing are barely visible at arm’s length
- No marks or scratches on the camera bezel / lens
- Fully functional, powers on and works as expected
- Original manufacturer parts, no third-party replacement parts
- Minimum 85% battery health
- Original software that has not been modified or jail broken
‘Good’:
- A phone that has lived a little with moderate signs of use
- Some cosmetic marks, but definitely no cracks or dents
- Up to 7 light scratches/marks on the screen, which are hardly visible when the screen is turned on.
- Up to 5 light scratches/marks on the phone housing/camera bezel
- Up to 3 light chips/scuffs on the phone housing/camera bezel
- No scratches on the camera lens
- Fully functional, it powers on and works as expected
- Original manufacturer parts, no third-party replacement parts
- Minimum 85% battery health
- Original software that has not been modified or jail broken
Although we administer a number of checks on each pre-owned and refurbished device to ensure each listing is accurate, if the device condition listed on our website does not match the device you receive, you may be entitled to a refund or replacement.
5.4 Warranties. When you purchase a phone from through our site, you will be provided with a 12 month warranty directly by us. Tablets will be provided with a 12 month warranty. We will be responsible for ensuring we deal with any issues you may have and solving these for you, we will either repair, replace or refund depending on what is more cost effective for us at the time of the warranty claim.
5.5 Buying Options. Listings will either include a “buy it now” price – enabling you to buy a device at a set price, or you can list an offer below the “buy it now” price and see if the price for the device moves – this is where an asking price and an offer you’ve made, match. When this happens, a transaction occurs and a trade confirmation will take place.
5.6 Product packaging. All devices, will be sent in a ‘Mozillion’ box and contain the device you’ve purchased. Packaging of the device may vary from that shown in images on our website, as website images are stock images and for illustration purposes only.
GENERAL RULES governing BUYING
6.1 To use and rely on our Mozillion services we provide, all participants, must understand their obligations to other users of Mozillion services. If you make an order to buy goods and we accept your order, you must complete the transaction.
6.2 Your making of an order entitles us to rely on your order and as a result you confirm and undertake that you have the legal right to make such an order and to enter into any such transaction.
6.3 If your order is accepted, you have entered into a contract to buy the item. You can only terminate that contract in limited circumstances set out in law, for example where the item does not materially comply with the information provided in relation to it. We may refuse to accept your order for whatever reason.
6.4 With regard to returns and refunds, please read paragraph 10. Your acceptance of these terms and conditions entitles us to assume you have read this paragraph.
6.5 Mozillion reserves the right to remove any account or prevent a trade from taking place in the event that we believe a buyer is found to be manipulating prices or markets.
Your Rights to Make Changes
If you wish to make a change to the device you have ordered please contact us, for example, if you wanted to change the quantity. We will let you know if the change is possible. If it is possible we will let you know about any changes to the price, the timing of supply or anything else which would be necessary as a result of your requested change and ask you to confirm whether you wish to go ahead with the change.
PRE-OWNED DEVICE CHECKS AND Changes
8.1 Our checks. We run a series of diagnostic checks on all pre-owned devices, to ensure the device works as it should and to ensure the device is not blacklisted or stolen.
8.2 Data. We ensure that any device you buy from us is wiped of all data contained on it. It will be supplied to you with factory settings enabled and no trace of any previous use. We wipe data in accordance with CESG standards, using a specialist third party.
8.3 More significant changes to devices and these terms. In addition, as we informed you in the description of the device on our website, we may make some changes to these terms, but if we do so we will notify you and you may then contact us to end the contract before the changes take effect and receive a refund for any products paid for but not received.
Providing the Products
9.1 Delivery costs. The costs of delivery will be as displayed to you prior to you making an offer to purchase a device. We use a number of different couriers depending on the nature of the delivery and the service you have chosen.
9.2 Delivery. We will deliver devices to you as soon as reasonably possible and in any event within 1-4 days after the day on which you have completed a transaction on our site. If you have chosen our premium service and have completed the transaction before our displayed cut off times, this could be next day delivery.
9.3 We are not responsible for delays outside our control. If our supply of the devices are delayed by an event outside our control then we will contact you as soon as possible to let you know and we will take steps to minimise the effect of the delay. Provided we do this we will not be liable for delays caused by the event, but if there is a risk of substantial delay you may contact us to end the contract and receive a refund for any products you have paid for but not received.
9.4 If you are not at home when the device is delivered. If no one is available at your address to take delivery and the products cannot be posted through your letterbox, you will need to rearrange delivery or collect the device from a local depot. Deliveries are made different couriers who will provide further information on how to facilitate the re-delivery or collection, as it may be.
9.5 When you become responsible for the device. The device will be your responsibility from the time the device is delivered to the address you gave us.
9.6 When you own a device. You own the device only once we have received payment in full.
9.7 What will happen if you do not give required information to us. We may need certain information from you so that we can supply a device to you, for example, up to date information on your Mozillion account. If we need further information, we will contact you to ask for this information. If you do not give us this information within a reasonable time of us asking for it, or if you give us incomplete or incorrect information, we may end the contract to supply you with a device. We will not be responsible for supplying any device late or not supplying any part of them if this is caused by you not giving us the information we need within a reasonable time of us asking for it.
9.8 Reasons we may suspend the supply of products to you. We may have to suspend supplying a device to you to:
9.8.1 deal with technical problems or make minor technical changes;
9.8.2 update the device to reflect changes in relevant laws and regulatory requirements;
9.8.3 make changes to the product as requested by you or notified by us to you (see paragraph 8).
9.9 Your rights if we suspend the supply of a device. We will contact you in advance to tell you we will be suspending supply of a device, unless the problem is urgent or an emergency. If we have to suspend the device, you may contact us to end the contract if we suspend it, or tell you we are going to suspend it.
RETURNS, REFUNDS and defective devices
10.1 Refunds and returns: You have the statutory right to cancel your order for any reason within 14 days beginning with the day you receive the item. Mozillion will provide you with up to a 12 month warranty directly from us for mobile phones and 12 months for tablets, details of which will be provided to you when you complete a transaction. The details we will provide you with will also confirm the length of the warranty we will offer, if this is different to the standard warranty provided under this clause 10.1. This will cover scenarios such as the device being not fit for purpose, is not as it is described or is faulty. See paragraph 11 for further details.
10.3 We will make any refunds due to you as soon as possible once approved and in any event within 14 days after the day on which we receive the device back from you and the return is approved.
10.3.1 Return cost and method, within the 14-day statutory period the cost is paid for by the buyer, a suitable tracked and insured method of return should be used, Mozillion will not accept any responsibility or financial liability for a non-delivered item. For a return outside of the 14-day period, the cost is paid for by the buyer. Mozillion will not be liable for any financial loss for a non-delivered item. If the device is found to be faulty, Mozillion shall reimburse the buyer for the postage cost of returning the device to Mozillion, up to maximum of £8.75 unless otherwise agreed (proof of postage cost paid may be required). If no fault is found, the cost of return and re-delivery will be paid for by the buyer on despatch. Mozillion will not be liable for any financial loss for a non-delivered item. It is recommended that any item being returned to Mozillion, that a fully insured tracked service, such as Royal Mail Special Delivery, is used along with the correct insurance as to financial value.
10.4 Exclusions, new devices must be returned, unopened, unused, in the original manufacturer packaging, correlating IMEI and serial number, undamaged. If a brand new device has been opened and the security seals broken and/or the device or manufacturer packaging is damaged in any way, we may offset any refund by the diminished amount of the product. Refurbished devices must be returned complete with the accessories supplied, identical IMEI, undamaged, in the original grade of condition as supplied, any damage or degradation of grade due to use may result in an offset in any refund due to the diminished grade, relating to Good As New, Excellent and Good. If a device does not meet the lowest criteria described as Good for resale due to damage no refund will be issued and the cost of return to be paid for by the buyer.
10.5 Refunds & Blacklisting, if in the event that any device is refunded, the ownership and title reverts to Mozillion. If any device is blacklisted the title reverts to the seller, whereby Mozillion will be reimbursed by the seller.
MOZILLION WARRANTY
11.1 Whenever you purchase a device on our website, we warrant that on delivery, and for a period of up to 12 months for phones and 12 months for tablets, from the date of delivery (warranty period), all devices shall:
11.1.1 conform with their description;
11.1.2 be free from material defects in design, material and workmanship;
11.1.3 be of satisfactory quality (within the meaning of the Sale of Goods Act 1979).
11.2 Subject to paragraph 11.3, if:
11.2.1 you give us notice in writing during the warranty period within a reasonable time of discovery that a device does not comply with the warranty
11.2.2 we are given a reasonable opportunity of examining such device; and
11.2.3 you return such device to us using the delivery method that we will send you, we shall, at our option, repair or replace the defective device, or refund the price of the defective device in full.
11.3 We will not be liable for a device's failure to comply with the warranty in paragraph 11.1 if:
11.3.1 you make any further use of such device after giving a notice in accordance with paragraph 11.2.1;
11.3.2 the defect arises because you failed to follow our oral or written instructions as to the storage, installation, commissioning, use or maintenance of the device or (if there are none) good trade practice;
11.3.3 you alter or repair the device without telling us;
11.3.4 water or liquid damage;
11.3.5 damage caused to removable covers such as battery covers, port/interface covers and lens caps;
11.3.6 you attempt or have attempted to root or jailbreak the device; or
11.3.7 the defect arises as a result of fair wear and tear, wilful damage, negligence, or abnormal working conditions.
11.4 These terms shall apply to any repaired or replacement devices supplied by us under paragraph 11.2.
11.5 Once we have dealt with a warranty issue, we will return your device to you free of charge one of our courier partners. If your device fails to comply with the warranty, due to one of the reasons listed above, you will be liable for the cost of return of the device.
Our Rights to End the Contract
12.1 We have in our sole discretion the right to issue a warning, temporary suspension, or an indefinite suspension and termination of your rights to use our platform if you:
12.1.1 act inconsistently and in breach of these terms;
12.1.2 at any time violate or attempt to violate any rights of any other platform user or third party;
12.1.3 are engaged in any fraudulent activity (including any market manipulation); or
12.1.4 fail to make any payments due to us in accordance with these terms.
12.2 On termination, all rights and obligations of the parties under these terms will, except that such rights and obligations will remain in effect after such termination to the extent necessary to process any orders placed prior to such termination for devices listed by a seller using the platform.
If There Is a Problem With a device
13.1 How to tell us about problems. If you have any questions or complaints about a device, please contact us. You can telephone our customer service team or email us at [email protected].
13.2 If your device is faulty. If your device is found to be faulty or develops a fault within the first 12 months of of purchase, Mozillion will offer you the choice to have the device repaired or replaced, subject to our warranty and return terms and conditions.
13.3 If your device is not as described. If upon receiving the device you find it is damaged or not in the condition expected then you need to report this to us using one of the methods stated in 13.1 within 24 hours of the phone being delivered to you.
13.4 Summary of your legal rights. See the box below for a summary of your key legal rights in relation to your device. Nothing in these terms will affect your legal rights.

The Consumer Rights Act 2015 says goods must be as described, fit for purpose and of satisfactory quality. During the expected lifespan of your product your legal rights entitle you to the following:
- —Up to thirty days: if your goods are faulty, then you can get an immediate refund.
- —Up to six months: if your goods can’t be repaired or replaced, then you’re entitled to a full refund, in most cases.
- —Up to six years (five years in Scotland): if your goods do not last a reasonable length of time you may be entitled to some money back.
Price and Payment
14.1 Where to find the price for the device. The requested price of the device will be the price indicated on the listing pages as a ‘buy it now’ price. Alternatively, you can make an offer to purchase the device at a lower price. If the device does not have a ‘buy it now’ price, you will need to make an offer which may be accepted or declined.
14.2 When you must pay and how you must pay. We only accept payment by UK credit or debit card/Paypal and you must pay for devices before they are dispatched. Mozillion reserves the right to request proof of payment method, proof of address and proof of identity to validate a transaction as deemed necessary, to prevent fraudulent transactions.
14.3 Our right of set-off if you are a business customer. If you are a business customer you must pay all amounts due to us under these terms in full without any set-off, counterclaim, deduction or withholding (other than any deduction or withholding of tax as required by law).
14.4 We can charge interest if you pay late. If you do not make any payment to us by the due date we may charge interest to you on the overdue amount at the rate of 4% a year above the base lending rate of Barclay’s Bank from time to time. This interest shall accrue on a daily basis from the due date until the date of actual payment of the overdue amount, whether before or after judgment. You must pay us interest together with any overdue amount.
INSURANCE
15.1 When you purchase a device, you have the option of purchasing additional insurance for an extended warranty, through Warranty and Creditor Services, who are a third party and who we are not affiliated with. It is entirely at your discretion as to whether you want to purchase additional insurance. Details are available on our website.
Our Responsibility for Loss or Damage Suffered By You If You Are a Consumer
16.1 We are responsible to you for foreseeable loss and damage caused by us. If we fail to comply with these terms, we are responsible for loss or damage you suffer that is a foreseeable result of our breaking this contract or our failing to use reasonable care and skill, but we are not responsible for any loss or damage that is not foreseeable. Loss or damage is foreseeable if either it is obvious that it will happen or if, at the time the contract was made, both we and you knew it might happen, for example, if you discussed it with us during the sales process.
16.2 We do not exclude or limit in any way our liability to you where it would be unlawful to do so. This includes liability for death or personal injury caused by our negligence or the negligence of our employees, agents or subcontractors; for fraud or fraudulent misrepresentation; for breach of your legal rights in relation to the devices.
16.3 We are not liable for business losses. If you are a consumer we only supply the devices for to you for domestic and private use. If you use the devices for any commercial, business or re-sale purpose our liability to you will be limited as set out in paragraph 17.
Our Responsibility for Loss or Damage Suffered By You If You Are a Business
17.1 Nothing in these terms shall limit or exclude our liability for:
17.1.1 death or personal injury caused by our negligence, or the negligence of our employees, agents or subcontractors (as applicable);
17.1.2 fraud or fraudulent misrepresentation;
17.1.3 breach of the terms implied by section 12 of the Sale of Goods Act 1979 or section 2 of the Supply of Goods and Services Act 1982; or
17.1.4 defective devices under the Consumer Protection Act 1987; or
17.1.5 any matter in respect of which it would be unlawful for us to exclude or restrict liability.
17.2 Except to the extent expressly stated in paragraph 12.1all terms implied by sections 13 to 15 of the Sale of Goods Act 1979 and sections 3 to 5 of the Supply of Goods and Services Act 1982 are excluded.
17.3 Subject to paragraph 17.1:
17.3.1 we shall not be liable to you, whether in contract, tort (including negligence), breach of statutory duty, or otherwise, for any loss of profit, or any indirect or consequential loss arising under or in connection with any contract between us; and
17.3.2 our total liability to you for all other losses arising under or in connection with any contract between us, whether in contract, tort (including negligence), breach of statutory duty, or otherwise, shall be limited to £75.
How We May Use Your Personal Information
How we will use your personal information. We will only use your personal information as set out in our Privacy Policy.
Other Important Terms
19.1 We may transfer this agreement to someone else. We may transfer our rights and obligations under these terms to another organisation. We will always tell you in writing if this happens and we will ensure that the transfer will not affect your rights under the contract.
19.2 You need our consent to transfer your rights to someone else. You may only transfer your rights or your obligations under these terms to another person if we agree to this in writing. For the avoidance of doubt the warranty supplied with the handset is not transferrable
19.3 Nobody else has any rights under this contract. This contract is between you and us. No other person shall have any rights to enforce any of its terms.
19.4 If a court finds part of this contract illegal, the rest will continue in force. Each of the paragraphs of these terms operates separately. If any court or relevant authority decides that any of them are unlawful, the remaining paragraphs will remain in full force and effect.
19.5 Even if we delay in enforcing this contract, we can still enforce it later. If we do not insist immediately that you do anything you are required to do under these terms, or if we delay in taking steps against you in respect of your breaking this contract, that will not mean that you do not have to do those things and it will not prevent us taking steps against you at a later date. For example, if you miss a payment and we do not chase you but we continue to provide the devices, we can still require you to make the payment at a later date.
19.6 Which laws apply to this contract and where you may bring legal proceedings if you are a consumer. These terms are governed by English law and you can bring legal proceedings in respect of the devices in the English and Welsh courts. If you live in Scotland you can bring legal proceedings in respect of the devices in either the Scottish or the English and Welsh courts. If you live in Northern Ireland you can bring legal proceedings in respect of the devices in either the Northern Irish or the English courts.
19.7 Which laws apply to this contract and where you may bring legal proceedings if you are a business. If you are a business, any dispute or claim arising out of or in connection with a contract between us or its subject matter or formation (including non-contractual disputes or claims) shall be governed by and construed in accordance with the law of England and Wales and the courts of England and Wales shall have exclusive jurisdiction to settle any such dispute or claim.

Provisions specific to consumers only are set out and clearly stated within these terms and those specific to businesses only are also clearly set out.
20.4 If you are a business customer this is our entire agreement with you. f you are a business customer these terms constitute the entire agreement between us in relation to your sale of devices. You acknowledge that you have not relied on any statement, promise, representation, assurance or warranty made or given by or on behalf of us which is not set out in these terms and that you shall have no claim for innocent or negligent misrepresentation or negligent misstatement based on any statement in this Agreement.

Our Contract With You
22.1 How we will accept your listing. Our acceptance of your listing will take place when we confirm we have received and accepted your listing, at which point a contract will come into existence between you and us for the selling of your device to Mozillion.
22.2 If we cannot accept your listing. If we are unable to accept your listing, we will inform you of this and, subsequently, your device will not be listed on our site. This might be because, for example, the phone you are trying to sell is described incorrectly, because of any issues regarding title and ownership of the phone or because we have identified an error or problem with your account as to previous sales.
22.3 Your listing number. For each listing we accept, we will assign you a unique number to your listing and tell you what it is when we accept that listing. If you need to discuss a listing with us, it will help us if you can tell us the listing number whenever you contact us.
22.4 We mainly list and sell UK devices. Our website is largely for the purchase and sale of our devices in the UK. Although in some cases we can list non-UK mobile devices, we reserve the right not to do so and may prohibit non-UK sales at our sole discretion.
Accounts

23.2 Security. You may not share these with or transfer them to any third parties. You must immediately notify us of any unauthorised use of them or any other breach of security regarding our Mozillion account.
23.3 Terms of Use. When signing up for a Mozillion account, you agree to comply with our Terms of Use. We reserve the right to remove your account at any time.
LISTING PROCESS
24.1 Device Description. When you list a device, whether as a consumer or a business customer, you will be required to list it under one of the following categories, that correspond with the condition of the device you want to sell. These categories are as follows:
‘New’: This is a brand new phone that has never been used and is in its original sealed box, complete with all accessories.
‘Good As New’: Fabulous.
- Hard to believe it's not brand new
- No cosmetic marks, scuffs, scratches, cracks or dents
- Fully functional, powers on and works as expected
- Original manufacturer parts, no third-party replacement parts
- Original box and accessories included
- Battery health 95% minimum
- Original software that has not been modified or jail broken
‘Excellent’:
- Minimal cosmetic marks, but definitely no cracks or dents
- Any light scratches/marks on the screen are not visible at arm’s length
- Any light scratches/marks on the phone housing are barely visible at arm’s length
- No marks or scratches on the camera bezel / lens
- Fully functional, powers on and works as expected
- Original manufacturer parts, no third-party replacement parts
- Minimum 85% battery health
- Original software that has not been modified or jail broken
‘Good’:
- A phone that has lived a little with moderate signs of use
- Some cosmetic marks, but definitely no cracks or dents
- Up to 7 light scratches/marks on the screen, which are hardly visible when the screen is turned on.
- Up to 5 light scratches/marks on the phone housing/camera bezel
- Up to 3 light chips/scuffs on the phone housing/camera bezel
- No scratches on the camera lens
- Fully functional, it powers on and works as expected
- Original manufacturer parts, no third-party replacement parts
- Minimum 85% battery health
- Original software that has not been modified or jail broken
These condition descriptions apply only to devices being listed and sold directly on Mozillion’s website. Devices being sold via third-parties such as but not limited to recycling comparison sites, have their own applicable condition descriptions and grading requirements.
24.2 Information you provide. You grant us a non-exclusive, worldwide, perpetual, irrevocable, royalty-free licence to use any information you provide to us or other users of our services, for example during the registration or listing process.
24.3 Device Models. You will only be able to sell the models of phone listed on our site. If you wish to sell a model that does not appear on our site, you will need to contact us to make a sell request. We will then confirm whether you are able to list and sell your device.
24.4 Device Condition You will need to describe the condition of each device before it is listed using the categories in paragraph 24.1. Any device sent to us that does not accurately reflect the description provided, that is faulty, blacklisted, or the sale cancelled due to late shipping, if received, subsequently will be subject to a return fee of £15.
24.4.1 Seller’s Conditions In the event that a phone becomes blocked, all sellers will be liable to reimburse Mozillion for the full refund issued to the buyer, along with any delivery and administration costs incurred.
24.5 Device Images. The images of the devices on our website are stock images, for illustrative purposes only. You will be unable to upload your own device images. Although we have made every effort to display the colours accurately on our site, we cannot guarantee that a device's display of the colours accurately reflects the colour of the devices. Your device may vary slightly from those images.
24.6 Selling Options. Once we have accepted a listing, your device will be listed on our site. When listing your device, you can either include a “buy it now” price – enabling Mozillion to buy your device at a set price, or you can list at your own price and see if an offer is made for your device. You can then choose whether to accept one of these offers, at which point a ‘trade’ is made and Mozillion will purchase your device.
GENERAL RULES when selling
25.1 In relation to any device you list for sale:
25.1.1 you must be the absolute unencumbered legal owner with the right to sell that device, Mozillion reserves the right to request the original proof of purchase as deemed necessary
25.1.2 your sale of the device must not infringe any third party rights or be unlawful in any way;
25.1.3 you must list your device in the correct category with accurate and appropriate descriptions and provide such information as we may request (see paragraph 24); and
25.1.4 although we will wipe all devices of any data contained on it, it still must not contain any offensive material, including material that incites racial hatred or promotes discrimination based on race, sex, religion, national origin, physical ability, sexual orientation or age.
Your Rights to Make Changes
If you wish to make a change to a listing you have requested please contact us. We will let you know if the change is possible. If it is possible we will let you know about any specific changes to the device you have requested to sell, or anything else which would be necessary as a result of your requested change and ask you to confirm whether you wish to go ahead with the change.
Selling Process
27.1 Once you have a confirmed sale, we will ask you to send your device directly to us within two business days or if you have used our premium service give directly to the courier after validating the authority of the pick up by a pin authorisation or any other means we choose to use.. We will email you instructions on how to send your device back, we highly recommend that you only send one device per package to ensure any insurance that may be included covers the value of the package. Once we have received your device, we will ensure it matches the device condition contained within your sell order (see paragraph 24.4).
27.2 Any device sent to us must: -
27.2.1 not be activation locked;
27.2.2 be deregistered from any associated account;
27.2.3 have its sim card removed; and
27.2.4 match the device description and condition you provided in your sell order.
27.2.5 The battery health must be 85% or above for Apple iPhones in ‘Good’ or ‘Excellent’ condition and 95% or above for Apple iPhones in ‘Good As New’ condition. The battery health for all other devices must be 'healthy'.
27.2.6 The device must contain only original manufacturer parts and components, including, but not limited to the display, screen, camera, battery and casing.
27.2.7 The device must not have been modified in any way.
27.3 Our checks. We will run a series of diagnostic checks on your device, to ensure the device works as it should, contains and uses only original manufacturer parts and components and to ensure the device is not blacklisted or stolen. Any device that does not pass these checks will be returned to you and a transaction fee imposed at our sole discretion – see paragraph 24.4. We will certify all devices that pass our checks and ensure this is listed next to your device listing.
27.4 Data. As part of our checks, we will complete a data wipe of your device in accordance with CESG standards, via a third party that we work with.
27.5 Age Restrictions. You must be 16 years of age or older to sell any device on Mozillion's website.
27.6 Unsuccessful deliveries. If we return your device and the carrier returns it to us because delivery was unsuccessful, we will contact you to arrange redelivery. If you do not reply within 180 days, we will dispose of the device with no further payments due from or to anybody
PAYMENTS AND COMMISSION
28.1 Payments. All payments will be held by our payment partners and transferred by them when the transaction has been approved, on occasion we may make payments directly to sellers using bank transfers or other means. This will be the case regardless of whether you are selling a new or pre-owned phone. Following completion of a transaction, we will send this to you within 14 days of us receiving payment from the buyer, less any fees. If you are using our premium service we may at our discretion only make payment if we have been able to verify you and your identity by using third party application and platforms.
28.2 Commission Rates. We charge a seller fee of 14.9% for each device sold to Mozillion, which we will deduct from the payment, before sending the remaining amount to you.
28.3 Commission Cap. In the case of individual device sales over £1500, the fee will be capped at £150.
28.4 Taxes. All payments and commission rates charged by us include value added tax.
28.5 Return costs If a phone does not meet the criteria as described within these terms and conditions and the transaction is cancelled and the seller will be required to pay the administration charge to cover the cost of delivery to and from Mozillion. This fee must be paid prior to despatch, and Mozillion’s decision as to condition, grade, fault, battery condition, not fit for purpose is final.
28.6 The seller is bound to provide the correct IMEI of the phone sold once the sale is confirmed, if the IMEI is not confirmed post sale, Mozillion reserves the right to cancel the order and condition 28.5 applies
Delivery
29.1 Delivery Process. Once a transaction has been concluded and payment received by us from a buyer, we will send the device to them by courier to the address provided by the buyer.
29.2 Notification. We will let you know when we have sent your device to the buyer, either by email or through your Mozillion account
WARRANTY and refunds
30.1 Warranty on devices. As we check all consumer devices (see paragraph 27.3), we offer the buyer of your device up to a 12 month warranty on each device (12 months on tablets).
30.2 Refunds. If a buyer returns the device to us, we will take ownership of any returned device before deciding what to do next, whether this be repairing the device or relisting it. This will not affect you in any way and we will not ask you to return any money to us unless clause 25.1.1 applies.
30.3 Business sellers are fully liablefor all refunded devices, and not withstanding a 12-month warranty.
How to End the Contract With Us
31.1 Tell us you want to end the contract. To end a listing, please let us know by doing one of the following:
31.1.1 Phone or email. Email us at [email protected]. Please provide your name, Mozillion account details and details of the request and, where available, your phone number and email address.
31.1.2 Online. Delete any listing on our site following the links from your account (so long as a transaction has not taken place)
31.2 When you can end the contract. You can end the contract with us at any point prior to a trade being confirmed, (whether either a by providing us with the information required in this paragraph 31. If you have sent us your device and, subsequently, end the contract, we may charge you postage fees to return your device to you. Please note, that if you are a business customer, ending the contract with us does not end your contract with each buyer of your device, created when you accept an offer from a buyer or accepting a “buy it now” offer.
Our Rights to End the Contract
32.1 We may end the contract if you break it. We have in our sole discretion the right to issue a warning, temporary suspension, or an indefinite suspension and termination of your rights to use and sell on the platform if:
32.1.1 you do not, within a reasonable time of us asking for it, provide us with information that is necessary for us to list your device;
32.1.2 you act inconsistently and in breach of these terms;
32.1.3 you at any time violate or attempt to violate any rights of any other user of the platform or third party;
32.1.4 we become aware of you not complying with the obligations owed to a buyer, such as providing a warranty and administering refunds; or
32.1.5 you are engaged in any fraudulent activity.

Our Responsibility for Loss or Damage Suffered By You If You Are a Consumer
34.1 We are responsible to you for foreseeable loss and damage caused by us. If we fail to comply with these terms, we are responsible for loss or damage you suffer that is a foreseeable result of our breaking this contract or our failing to use reasonable care and skill, but we are not responsible for any loss or damage that is not foreseeable. Loss or damage is foreseeable if either it is obvious that it will happen or if, at the time the contract was made, both we and you knew it might happen, for example, if you discussed it with us during the sales process.
34.2 We do not exclude or limit in any way our liability to you where it would be unlawful to do so. This includes liability for death or personal injury caused by our negligence or the negligence of our employees, agents or subcontractors; for fraud or fraudulent misrepresentation; and for defective devices returned to you under the Consumer Protection Act 1987.
34.3 We are not liable for business losses. If you are a consumer we only list devices for you for domestic and private use. If you use the device for any commercial, business or re-sale purpose our liability to you will be limited as set out in paragraph 35.
Our Responsibility for Loss or Damage Suffered By You If You Are a Business CUSTOMER
35.1 Nothing in these terms shall limit or exclude our liability for:
35.1.1 death or personal injury caused by our negligence, or the negligence of our employees, agents or subcontractors (as applicable);
35.1.2 fraud or fraudulent misrepresentation;
35.1.3 breach of the terms implied by section 12 of the Sale of Goods Act 1979 or section 2 of the Supply of Goods and Services Act 1982; or
35.1.4 defective devices returned to you under the Consumer Protection Act 1987; or
35.1.5 any matter in respect of which it would be unlawful for us to exclude or restrict liability.
35.2 Except to the extent expressly stated in these terms, all terms implied by sections 13 to 15 of the Sale of Goods Act 1979 and sections 3 to 5 of the Supply of Goods and Services Act 1982 are excluded.
35.3 Subject to paragraph 35.1:
35.3.1 we shall not be liable to you, whether in contract, tort (including negligence), breach of statutory duty, or otherwise, for any loss of profit, or any indirect or consequential loss arising under or in connection with any contract between us; and
35.3.2 our total liability to you or all other losses arising under or in connection with any contract between us, whether in contract, tort (including negligence), breach of statutory duty, or otherwise, shall be limited to £500..
How We May Use Your Personal Information
How we will use your personal information. We will only use your personal information as set out in our Privacy Policy.
Other Important Terms
37.1 We may transfer this Agreement to someone else. We may transfer our rights and obligations under these terms to another organisation. We will always tell you in writing if this happens and we will ensure that the transfer will not affect your rights under the terms.
37.2 You need our consent to transfer your rights to someone else. You may only transfer your rights or your obligations under these terms to another person if we agree to this in writing. For the avoidance of doubt the warranty supplied with the handset is not transferrable.
37.3 Nobody else has any rights under this contract (except someone you pass your guarantee on to). This contract is between you and us. No other person shall have any rights to enforce any of its terms, except as explained in paragraph 37.2 in respect of our guarantee. Neither of us will need to get the agreement of any other person in order to end the contract or make any changes to these terms.
37.4 If a court finds part of this contract illegal, the rest will continue in force. Each of the paragraphs of these terms operates separately. If any court or relevant authority decides that any of them are unlawful, the remaining paragraphs will remain in full force and effect.
37.5 Which laws apply to this contract and where you may bring legal proceedings if you are a consumer. These terms are governed by English law and you can bring legal proceedings in respect of the devices in the English and Welsh courts. If you live in Scotland you can bring legal proceedings in respect of the devices in either the Scottish or the English and Welsh courts. If you live in Northern Ireland you can bring legal proceedings in respect of the devices in either the Northern Irish or the English and Welsh courts.
37.6 Which laws apply to this contract and where you may bring legal proceedings if you are a business. If you are a business, any dispute or claim arising out of or in connection with a contract between us or its subject matter or formation (including non-contractual disputes or claims) shall be governed by and construed in accordance with the law of England and Wales and the courts of England and Wales shall have exclusive jurisdiction to settle any such dispute or claim.
Postage & Packaging: Sending Items to Mozillion
38.1 Phones and devices must be packaged in accordance with our packaging instructions to ensure safe and successful delivery to us.
38.2 As we are not the legal owner of the goods at time of you sending the device(s) to us, our ability to make claims for loss or stolen items on your behalf maybe impacted as a result. We do not accept responsibility for loss of goods from third party providers, but will assist you (in the rare cases where this is required) where we are able.
38.2.1 For the avoidance of doubt, please note you will be covered up to:
- £100.00 with DPD
- £150.00 tracked 48 with Royal Mail
- £750.00 special delivery with Royal Mail (this will be subject to you filing the claim)
We recommend if you have an order of significant value that you use the Royal Mail special delivery.
38.3 If you believe that your package being sent to Mozillion (including but not limited to phones sold on Mozillion’s platform and returns that you have purchased and are returning to us) has been lost, damaged or stolen (subject to our confirmation that we have not received your package) you will be required to provide a valid returns or postage receipt which you will have been provided with by the relevant carrier.
38.4 It is your responsibility to obtain a receipt from the carrier regardless of which postage service you use, including but not limited to any provided by Mozillion, and retain this for tracking and insurance purposes. As part of the claims process, you may be required to provide the serial number and/or IMEI number of any items contained in your package (along with proof of purchase). You can find the IMEI of a mobile phone by calling *#06# or by going into your device settings. If you can’t provide a valid returns receipt, proof of purchase and serial/IMEI number, you may not be able to claim for any loss or damage to your package (subject to our confirmation that we have not received your package).
38.5 You must notify us in writing of any loss or damage, within seven (7) days of the date on which your package was accepted by the carrier. This is so we can assist you in making a claim if required within the deadlines set by third party carriers.
38.6 It is your responsibility to raise a claim with the carrier for lost, damaged or stolen packages. Mozillion have no obligation to submit a claim to the carrier on your behalf but will assist you where we are able.
38.7 If you have used a postal service provided by Mozillion and fail to provide a valid receipt within seven (7) days of the date of your returns receipt, we have no obligation to assist with a claim to the carrier on your behalf.
38.8 We shall be entitled to make our own investigations as we deem necessary to satisfy ourselves of the validity of any claims.
38.9 In calculating the value of any claim we shall accept no other valuations than our own for the items that you may be claiming for and under no circumstances do we accept any liability for any other loss, damage or compensation resulting from the use of our Delivery Services.
39.0 We will notify you in writing of the outcome of our investigation and, if any claim is successful, payment of the valuation will be made via the payment method specified in your account on our website.

Terms for your Mozillion mobile plan.
These Terms and Conditions
1.1 We are Mozillion Limited, a company registered in England and Wales under company number 11864919. Our registered office is at Mozillion, 15 West Street, Brighton, England, BN1 2RL. “Mozillion”, “we”, “us” and “our” mean Mozillion Limited.
1.2 These terms apply when you order or use a Mozillion SIM, eSIM or Airtime Plan. Your order confirmation, Contract Information and Contract Summary, price guide, plan description and any policy expressly incorporated into your contract also form part of your agreement with us. If those documents conflict, the document that is more specific to your Plan takes priority, subject always to your legal rights.
1.3 Please read these terms before ordering. They explain the service, charges, permitted use, our powers to restrict or suspend service, and how either of us may end the agreement. Nothing in these terms limits rights that cannot lawfully be limited.

2.1 The quickest way to contact us is by email at [email protected]. Current contact routes, accessibility support and our Complaints Code are available on the Mozillion website.
2.2 You must keep your contact details up to date so that we can send important service and contract notices to you.
Your Mozillion Airtime Plan
3.1 Your Plan starts on the activation date stated in your order confirmation. We normally deliver physical SIMs within 1–2 working days, but delivery estimates are not guaranteed.
3.2 Your price, minimum term, allowances, renewal date and any recurring or one-off charges will be set out in your Contract Information, Contract Summary and order confirmation. Payments are taken in advance for each billing period unless we tell you otherwise.
3.3 Plans are intended for normal person-to-person, personal and non-commercial use, subject to clauses 10 and 11. An Unlimited Data Plan has no fixed domestic data allowance or automatic cut-off. A 500GB monthly Fair Use threshold applies as explained in clause 11.3. Exceeding that threshold does not create an additional charge or, by itself, permit suspension or termination.
3.4 Calls and texts to numbers beginning 08, 070, 09 and 118, premium-rate services and other services identified in the price guide are not included unless your Contract Information expressly says otherwise.
3.5 Coverage, technology and speeds vary with location, device capability, network demand, geography, weather and other factors. Coverage maps are estimates, not guarantees. We will provide any applicable minimum service-quality information before contract as required by law.
3.6 For capped plans, we will provide usage information and any alerts required by law or described in your Plan. When an allowance is exhausted, we will stop the relevant service unless you actively buy an add-on or have clearly agreed in advance to specified out-of-bundle charging.
Interruptions and changes to the service
4.1 We may carry out maintenance, respond to emergencies, protect security or comply with legal or regulatory duties. Where reasonably possible, we will give advance notice of a planned material interruption and minimise its effect.
4.2 If an interruption for which we are responsible lasts more than a short period, we will apply any refund, compensation or other remedy required by this agreement or law. Your rights under clause 6 are unaffected.
4.3 We may manage traffic only where reasonably necessary, proportionate and consistent with applicable law, our published information and your contract—for example to protect network integrity or address temporary congestion. We will not describe a material, customer-specific usage restriction as ordinary network management.
If there is a problem
5.1 Contact us promptly if your service is unavailable, materially below the service described, or incorrectly charged. We will investigate and take reasonable steps to correct the problem.
5.2 We will provide the service with reasonable care and skill and in accordance with this agreement. Your statutory remedies are not excluded.
Your right to cancel or end the agreement
6.1 If you are a consumer and ordered at a distance, you may cancel within 14 days after the contract is made. If you asked us to start service during that period, we may charge a proportionate amount for service supplied before cancellation, where the law allows.
6.2 You may end a one-month rolling Plan on 30 days’ notice, or by using an applicable switching process. Fixed-term Plans may be ended at the end of the minimum term on the notice stated in your Contract Information. After the minimum term they continue on a monthly basis unless we tell you otherwise in accordance with law.
6.3 If you end a fixed-term Plan early without a contractual or statutory right to do so, an early termination charge may apply only if it was clearly disclosed before contract, is calculated as described in your Contract Information and is lawful. We will not charge more than the amount properly due after applicable savings and discounts.
6.4 You may end the agreement without an early termination charge where we make a contractual change that gives you that right under clause 9, where we materially breach the agreement and do not remedy the breach within a reasonable time, or where law otherwise permits. We will refund prepaid recurring charges for the period after the service ends, subject to lawful deductions.
6.5 Request a PAC by texting PAC to 65075 or a STAC by texting STAC to 75075. We will comply with applicable switching and number-porting rules.
Charges and payment safeguards
7.1 You must pay charges that were clearly disclosed and agreed. Our current price guide applies only where it was incorporated into your contract and the relevant charge is clearly linked to the service or usage concerned.
7.2 We will not retrospectively convert usage included in an unlimited allowance into out-of-bundle usage merely because we later decide that the pattern was outside Fair Use. Unless your Contract Information contains a clear, prominent and lawful charging mechanism, our Fair Use remedies are warning, reasonable restriction, migration with your agreement, suspension or termination—not an unexpected usage invoice.
7.3 Before any avoidable out-of-bundle charge begins, we will give any alert required by law and, where technically practicable, tell you the applicable rate and provide a reasonable opportunity to stop or buy an add-on. We will bill accurately and make adequate, up-to-date usage and billing information available.
7.4 If payment is overdue, we will normally contact you and allow a reasonable opportunity to pay before restricting service. Immediate action may be taken where fraud, security or law requires. Any restriction will be proportionate and will take account of known vulnerability and access to emergency services where applicable.
Our responsibility to you
8.1 Nothing excludes or limits liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, breach of rights that cannot lawfully be excluded, or any other liability that law does not permit us to exclude.
8.2 If you are a consumer, we are responsible for foreseeable loss or damage caused by our breach or failure to use reasonable care and skill. We are not responsible for loss that is not foreseeable or for business loss where you use a consumer Plan for business purposes.
Contract changes and notices
9.1 We may make changes that are exclusively to your benefit, purely administrative with no negative effect, or directly required by law. We will explain material changes clearly and keep an accessible record of the version and effective date.
9.2 For any other contractual change, we will give affected customers at least one month’s notice in a durable medium, explain the change and its effective date, and inform them of any right to end the contract without additional cost. Where Ofcom rules require a right to exit, it may be exercised within the period stated in the notice and at least as required by those rules.
9.3 Publishing revised terms on a website, or a customer’s continued use after publication, does not by itself make a materially adverse change binding on an existing customer. We will retain evidence of the version accepted at sign-up and of any later notice and consent or termination right.
9.4 If we amend a Fair Use or Responsible Use policy in a way that materially expands prohibited use, adds a charge, or increases our enforcement powers, we will treat that as a contractual change under this clause rather than an informal policy update.
Roaming Fair Use
10.1 Roaming is for periodic travel, not permanent or long-term use abroad. The destinations, allowances, eligibility tests and any surcharges that apply will be clearly stated in your Contract Information or roaming price guide before they apply.
10.2 Where a roaming cap applies, we will notify you as required by law before additional charges or restrictions apply. We will not change a roaming allowance or charge merely at our sole discretion; clause 9 applies to contractual changes.
10.3 We may investigate prevailing presence and use over a reasonable rolling period. Before imposing a surcharge or restriction for roaming misuse, we will give any warning and remedy period required by law and tell you how to challenge our assessment.
Fair Use and Responsible Use
11.1 Purpose and scope. Plans are priced using reasonable assumptions about legitimate personal, non-commercial mobile use. Fair Use is not a hidden usage allowance and does not permit arbitrary action. We assess the nature, pattern, duration and effect of use, the Plan description, the device used, relevant network evidence and comparison with genuinely comparable consumer usage.
11.2 Use that falls, or may fall, outside Fair Use includes:
- using a consumer Plan to administer, promote or market a business, group or organisation, including calls or messages to a customer base or non-personal distribution list;
- commercial exploitation, resale, unsolicited bulk communications, automated calling or messaging, spam, SIM-box or gateway operation;
- call forwarding services, concurrent calling, paging, onward-calling services, or calling numbers that pay the caller or another person a revenue share, financial return or other reward;
- generating artificially inflated traffic, persistently automated or unsolicited messages, unusually high recipient volumes, or gaming or exploiting the design of billing, allowance or call-record systems;
- fraudulent, unlawful, abusive, harassing, threatening or nuisance communications;
- use that materially harms network security, integrity, capacity, other customers or service quality;
- materially and persistently abnormal voice, SMS or data use compared with ordinary consumers on a comparable Plan, where the circumstances do not reasonably indicate legitimate personal use; and
- use in equipment or for a purpose that the specific Plan description clearly excludes.
11.3 Data Plans and 500GB monthly Fair Use threshold. A Data Plan may be used in a SIM-enabled phone, tablet or laptop and, only where the Plan description permits, a portable mobile Wi-Fi device. Unlimited Data Plans are subject to a Fair Use threshold of 500GB of UK data in each billing month. After 500GB, we may give the affected traffic lower priority than other customers’ traffic at busy times and in congested locations for the remainder of that billing month. This does not reduce the amount of data available, impose an additional charge or automatically suspend or disconnect the service. Any effect must be moderate, proportionate, temporary and limited to managing congestion. Full normal priority will be restored at the start of the next billing month. A consumer mobile Plan must not be used as a permanent, long-term substitute for fixed home or business broadband. Occasional tethering for personal use is allowed. The number of connected devices is evidence to consider, not an automatic breach by itself.
11.4 Equipment and intended purpose. You may use a SIM only in equipment, and for the purpose, advertised in the applicable Plan description or expressly approved by us. Voice Plans may be used only in SIM-enabled mobile phones. You must not establish, install or use a gateway device or SIM box without our prior written consent. Voice or SMS use through a fixed router, GSM gateway, SIM box, modem or similar equipment—including equipment tethered to a computer or the internet for large-volume calls or messages—is prohibited unless we expressly agree otherwise. Using a SIM in or with equipment for an unintended continuous-monitoring or automated purpose, such as using a phone or tablet as a baby monitor, may also fall outside Fair Use. Device evidence must be reasonably reliable and customers may challenge it.
11.5 High voice and SMS use. High usage alone does not prove business use. We may act where objective evidence shows use is materially and persistently outside what is reasonably expected of an ordinary consumer using the Plan privately, personally and legitimately. Relevant indicators include unusually high call volumes, multiple calls at the same time, unusually high message volumes, unusually large numbers of recipients or distribution groups, automated or unsolicited messages, revenue-generating calls, and use connected with a business or non-private group. We will consider volume, frequency, duration, automation indicators, recipient patterns, device type, network effect, the review period and any explanation provided. We will not enforce an unpublished automatic numerical voice or SMS threshold.
11.6 Fair process. Except where immediate action is reasonably necessary for fraud, illegality, security, serious network harm or a clear serious device breach, we will contact you first, explain the relevant evidence and contractual concern, and give a reasonable opportunity to respond or change the use. We will consider disability, vulnerability and other relevant circumstances.
11.7 Proportionate action. Crossing the 500GB threshold in clause 11.3, without more, permits only the moderate congestion-management measure described there. It does not establish commercial, illegitimate or prohibited use. For a separate breach supported by objective evidence, and depending on seriousness and whether the issue can be remedied, we may warn you, apply targeted network-protection controls, remove access to an affected allowance or add-on where the applicable Plan terms clearly permit this, offer a more suitable Plan, suspend under clause 15, or end the agreement under clause 16. We will not apply a remedy more restrictive than reasonably necessary.
11.8 Charges. A Fair Use concern does not itself create a charge. Charges may be imposed only in accordance with clause 7 and a clear pre-agreed price term. We will not issue retrospective charges by applying an ordinary out-of-bundle rate to use that was represented as included or unlimited.
11.9 Underlying network controls. Our Services use an underlying mobile network whose consumer fair-usage and network-protection requirements we must observe. Where data use may materially affect service levels for other customers, appropriate traffic shaping, throttling or other network-protection controls may be applied at particular times or locations. Any control we apply or pass through must be consistent with your Plan information and applicable law. The specific 500GB rule in clause 11.3 remains the only automatic domestic data-volume threshold in this agreement; other action requires evidence of a separate Fair Use breach or genuine network-protection need.
Complaints and dispute resolution
12.1 We will handle complaints fairly, efficiently and confidentially under our published Complaints Code. The Code identifies our Ofcom-approved alternative dispute resolution scheme and explains when you may refer a complaint, free of charge. A deadlock letter may allow an earlier referral.
12.2 Using our complaints process or ADR does not affect other legal rights or remedies.
Withdrawal of a Service or Plan
13.1 We may permanently discontinue a Service or Plan for genuine commercial, operational, technical, legal or regulatory reasons. This clause concerns withdrawal affecting a class of customers generally; it is not a substitute for the customer-specific Fair Use and breach process in clauses 11, 15 and 16.
13.2 We will give affected customers at least one month’s notice in a durable medium, or longer where required by law. A shorter period will be used only where objectively necessary because of urgent legal, regulatory, security or technical circumstances beyond our reasonable control.
13.3 The notice will explain what is ending, why, the end date, any migration option, how to preserve or port a number, and the right to terminate without additional cost. We will refund prepaid recurring charges for the period after withdrawal and will not charge an early termination fee for the affected service.
Replacement SIMs and eSIMs
14.1 Contact customer services if a SIM or eSIM is lost, stolen, damaged or needs to be swapped. A replacement fee may apply only if disclosed in the current price guide and permitted by law.
Suspension and restriction
15.1 We may suspend or restrict some or all service where we reasonably believe: payment is overdue; account or identity information is materially false; a SIM is lost, stolen or used contrary to the agreement; there is fraud, illegality, security risk, serious nuisance activity or material network harm; a competent authority requires action; or clause 11 permits proportionate enforcement.
15.2 We will normally give notice, reasons, supporting information sufficient to understand the concern, and a reasonable opportunity to respond or remedy it. We may act without prior notice only where immediate action is reasonably necessary and proportionate. We will notify you as soon as reasonably practicable afterwards unless law prohibits it.
15.3 A clear gateway, SIM-box or prohibited-device finding may justify immediate targeted suspension. We will promptly tell you the basis and ordinarily allow at least 24 hours to dispute the device evidence before deciding whether to terminate, unless fraud, illegality, security or serious harm requires faster action.
15.4 Suspension is not termination. We will review it promptly, restore service when the reason is resolved, and explain any next step. Charges during suspension will be fair, transparent and reflect the circumstances; we will not charge for service we fail to provide where law or this agreement requires a refund.
Ending the agreement and disconnection
16.1 We may end the agreement on at least 30 days’ notice for a legitimate reason, including persistently abnormal personal-use patterns that fall outside clause 11 after fair assessment. The notice will state the reason, evidence in summary, termination date, how to challenge the decision, switching or porting information, and any refund or amount due.
16.2 We may terminate immediately only for a sufficiently serious breach or circumstance—for example substantiated fraud or illegality, serious security or network harm, a serious prohibited-device breach unlikely to be rectified, or failure to remedy a material breach after a reasonable opportunity. We will act reasonably and proportionately and notify you promptly.
16.3 We will not terminate merely because usage is high, or label high usage “business use”, without an evidence-based assessment under clause 11.5. During a 30-day notice period we may monitor use and apply an earlier targeted restriction only if clause 15 is independently satisfied.
16.4 For non-payment, we will follow clause 7.4 and any applicable Ofcom rules. Any early termination charge, outstanding balance, refund or forfeiture will be calculated transparently and lawfully. We will not automatically forfeit all prepaid sums regardless of service supplied or circumstances.
16.5 If we terminate this agreement because of your material breach, we will refund any recurring charges paid in advance for the period after termination, less: (a) charges properly due for Services supplied before termination; and (b) any reasonable, direct and evidenced loss caused by your breach that we are legally entitled to recover. We will provide a clear explanation and calculation of any deduction. Nothing in this clause permits us to impose a penalty, retain more than our lawful loss, or charge twice for the same loss.
Effect of ending and other legal terms
17.1 When the agreement ends, we will disconnect the service and close the account after completing necessary billing and regulatory steps. You may lose your number unless you request porting in time. We will comply with applicable number-porting and switching rules.
17.2 We use personal information as described in our Privacy Policy and applicable data-protection law, including where we analyse usage and device information for fraud, network management and Fair Use enforcement.
17.3 If part of this agreement is invalid or unenforceable, the remaining terms continue so far as possible. A delay in enforcing a right is not a waiver.
17.4 English law governs this agreement. Consumers may bring proceedings in the courts of the part of the United Kingdom in which they live, as applicable. Nothing prevents use of our complaints process or ADR.

Introduction
If you read this, it means you are equipped with a Mozillion branded (e)SIM card, giving you access to mobile data services in various countries (“Services”). The (e)SIM card and the Services are provided by Mozillion Ltd or one of its affiliates under the present Terms & Conditions (“T&C’s). The Services may be embedded into different kind of device, including (without limitation): a connected car, a laptop, a tablet or an equivalent device from an authorized original equipment manufacturer, etc. (“Device”).

Definitions and Framework
The “Service” is available for purchase exclusively using the Mozillion.com website on an authorized Device. The Service may not be available in all areas and on all devices and is subject to these T&C’s. The Service consists in providing prepaid cellular Data Plans (allowance of data valid for a certain duration) to enable connecting your Device to the Internet (the “Data Plans”). The countries in which You can use the Data Plans are listed where You browse through available offers. Available offers may change from time to time and may depend on the country You are currently in. By purchasing the Service, You agree that You are authorized to use the Service and are responsible for paying for the Service per these T&C’s.
These T&C’s, including the provisions regarding the personal data protection referenced herein (collectively, the “Agreement”), set forth the T&C’s that apply to your use of the Service. “Customer”, “You” and “your” mean the customer of the Service defined above, and “Mozillion”, “we”, “our”, and “us” include Mozillion Limited and any of its affiliates involved in providing You with the Service. Your enrollment in, use of or payment for the Service, confirms your unconditional acceptance and agreement to the T&C’s set forth in this Agreement available on [www.mozillion.com](https://www.mozillion.com). If You do not agree to be bound by this Agreement, You may not use the Service.
We may modify or amend this Agreement from time to time, in accordance with applicable laws. Unless otherwise provided in this Agreement, all such modifications or amendments shall be effective immediately upon posting on [www.mozillion.com](https://www.mozillion.com) (the “Website”). Where we make a significant change to this Agreement, we will endeavor to separately notify You about this change. YOUR CONTINUED USE OF THE SERVICE AFTER THE POSTING ON THE WEBSITE WILL BE CONCLUSIVELY DEEMED TO BE ACCEPTANCE BY YOU OF ANY SUCH MODIFICATIONS OR AMENDMENTS.
To support the Service, Mozillion has entered into agreement with various cellular carriers (mobile operators) around the world to access their cellular networks (collectively referred to as the “Mobile Network”). In providing the Service Mozillion is not providing You with a phone number, and is not providing You the ability to place or receive voice telephone calls (including calls to 911 and other emergency numbers) or send or receive SMS or text messages.
Agreement
This Agreement will commence, and a binding contract will exist between Mozillion Ltd and the Customer when the Customer starts using the Service. It will continue until terminated as set forth herein. The Service is sold exclusively on a prepaid basis.
All services, including any related offers and promotions may be subject to specific additional T&C’s. Please check our Website regularly as these T&C’s are updated from time to time.
You will remain responsible to us under this Agreement for the actions of any other person You allow to use the Services on your account.
Our obligations
Mozillion Ltd will provide the Service in accordance with the Agreement, and as per the applicable Data Plan description, and from the date the Customer starts using the Service or purchases such Data Plan. We will try to make sure that the Service is available to You wherever possible; however both availability and quality of the Service may be affected by things we cannot control such as physical obstructions, atmospheric conditions and outages on the Mobile Network (the infrastructure, software and hardware enabling a cellular carrier / mobile operator to support wireless internet services offered to subscribers) where such outages and their remedies are not within our control. We or our mobile operator partners (any company operating a mobile internet network, which owns or controls all the elements necessary to sell and deliver mobile internet services) may from time to time need to carry out upgrade or maintenance work on the Mobile Network which may affect the availability and/or quality of the Service. We will endeavour to keep such disruption to a minimum, but this may not always be within our control.
We shall provide the Service with reasonable skill and care, and we shall use reasonable efforts to make the Service available to You. If You experience problems with our Service or suspect fraudulent activity on your account, please contact the Customer Service immediately.
We may from time to time and without notice, change the Service in order to comply with safety, regulatory, statutory and other requirements. We will try to ensure that this does not materially affect the scope of the Service.
Your obligations
You must use the Service in accordance with this Agreement and any other reasonable instructions we or the Customer Service give You from time to time. In particular, You are not authorized to use the (e)SIM card in any other device than the Device it was delivered with or supposed to be used with (if not delivered with the (e)SIM card). It is also clarified that the (e)SIM card remains the property of Mozillion Ltd and/or its chosen partners. You must disclose your country and residence to us when You open your Account.
According to applicable laws, You may have to provide us with a copy of your ID (national ID card or passport) before You first begin to use the services or at the latest within fifteen (15) days from the date You start using the Service. If not we reserve the right to suspend immediately the services.
The (e)SIM card does not have a PIN code by default. YOU ARE SOLELY RESPONSIBLE FOR CONTROLLING THE ACCESS TO YOUR (e)SIM CARD, AND YOU AGREE TO PAY FOR THE SERVICE WHETHER OR NOT YOU HAVE AUTHORIZED SUCH USE. WE SHALL NOT BE HELD RESPONSIBLE FOR FRAUDULENT USE OF YOUR (e)SIM CARD. If You believe that your (e)SIM card is being used in an unauthorized manner, You must contact the Customer Service immediately so that the appropriate modifications can be made to your account.
The (e)SIM card is attributed to the first Device owner. The first Device owner remains liable for its use at any time unless Mozillion Ltd has received a proof of the change of the Device’s ownership. The Service is intended to be used for web browsing, email, uploading and downloading applications and content to and from the Internet or third-party applications, and using applications and content without excessively contributing to network congestion.
You will not use the Service for any unlawful, abusive or fraudulent purpose, including, for example, using the Service in a way that (1) interferes with our ability to provide Service to You or other customers; (2) abuses any bonus or promotional program; or (3) avoids your obligation to pay for the Service. You will not use the Service in a way that compromises network security or capacity, excessively and disproportionately contributes to network congestion, adversely impacts network service levels or legitimate data flows, degrades network performance, causes harm to the network or other customers.
You will not take any action that would, in Mozillion’s sole determination, interfere with the Service or other Mozillion customers, infringe the rights of any third party, or otherwise constitute objectionable conduct. If we have reasons to believe that You or someone else using your (e)SIM card is abusing the Service or otherwise breaching this Agreement, we may immediately suspend, restrict, or cancel your (e)SIM card and your ability to use the Service without notice. In addition, we reserve the right, at our sole discretion and for any reason, to (a) suspend, restrict, modify or terminate your (e)SIM card and your access to and use of the Service and/or (b) refuse to allow You to buy any new Data Plans. You are responsible for all charges incurred on your account whether or not they are incurred by You personally except those incurred after You have notified the Customer Service of the loss or theft of your (e)SIM card, and the Customer Service has acknowledged it in writing.
Eligibility
If You are under 18 years old, your parent or legal guardian must also read and agree to be bound by these T&C’s. You agree that You are responsible for paying the charges to use the Service, or if You are under 18, that You have permission to use the Service from the adult responsible for paying the charges.
You acknowledge that Mozillion Ltd may immediately suspend certain services in order to comply with applicable laws. You are solely responsible for the content You transmit via the Service. We will not be responsible for any content sent or received by You.
You are responsible for updating the Customer Service as soon as reasonably possible of any changes to your contact details.
Charges
In order to use the Service You must have a valid Data Plan. For a Data Plan to be valid, it needs to be neither exhausted nor expired and it needs to be valid in the country You are currently in. You can check whether You have a valid Data Plan via the Mozillion dashboard. When You are using the Service and your Data Plan runs out (i.e. exhausted or expired), the access to Internet will be automatically suspended.
Your Data Plan will be debited per your usage of the Service (consuming your data allowance).
Data Plan allowances may only be used for our Service on your Device, and You will not be entitled to receive any cash refund for any remaining credit or allowance unless expressly stated otherwise in this Agreement. Credits and allowances are not transferable, and no interest will be payable on credit balances or allowances.
Taxes and Other Charges
You must pay all taxes, fees, surcharges and other charges that we bill You for the Service. We will not provide advance notice of changes to taxes, fees, surcharges and other charges, except as required by applicable law.
When may we suspend or disconnect your Service
We may, without liability to You, suspend or disconnect the Service and/or your (e)SIM card, without notice:
- a)If we are entitled to terminate this Agreement due to your failure to comply with this Agreement but elect to provide You with an opportunity to remedy such failure whenever reasonably practicable
- b)If we are required to do so by the Government and/or emergency service organization or any other competent body or lawful authority
- c)For repairs or maintenance, or for operational or security reasons
- d)In circumstances where we observe fraudulent or unusual use of your (e)SIM card or one or more service (e.g. abnormally high usage patterns)
- e)If we have a good reason to suspect a breach by You of this Agreement
- f)If Mozillion Ltd or its partners become aware that your (e)SIM card has been stolen/lost/damaged or destroyed
- g)If your (e)SIM card or Device is interfering with the normal operation of the network or if your account is in arrears
- h)If You do not use the Services in compliance with applicable laws and regulations
- i)If You have continually not used the Service since You acquired the (e)SIM card and/or if You have not refilled your account after your credit has expired for an extended period of time, in accordance with applicable laws
- j)If You use the (e)SIM card in a device other than the Device in which it was delivered
- k)If You did not use the (e)SIM card after eighteen (18) months
If we suspend or disconnect your Service we will give You the opportunity to restart the Service during a period of 3 months after the Service has been suspended, provided You comply with the Mozillion requirements.
Internet access
We do not make any warranty as to the accuracy, completeness, reliability or continuous supply of the content or information contained on any third-party sites or resources accessed via the Service. We will not be responsible for any harm You suffer from any virus that gains access to your equipment, whether transmitted via the Service or otherwise. It is your responsibility to protect your equipment with suitable anti-virus software.
Devices
You must use the Service in accordance with this Agreement and any other reasonable instructions we or the Customer Service give You from time to time. In particular, You are not authorized to use the (e)SIM card in any other device than the Device it was delivered with.
If you purchased specifically an eSIM Data Plan on the Mozillion website, or on other partners ecommerce platforms/ marketplaces, It is your sole responsibility to ensure that your Device is eSIM compatible and not carrier-locked.
You should always refer to the specifications of the manufacturer of your device to check compatibility.
Refund policy
For an eSIM profile with a preloaded plan purchased on our website: the refund of your preloaded eSIM profile is only possible if you have not scanned the QR code received by email after your purchase. If you have already scanned the received QR code, your refund request will be denied.
For an eSIM profile with a preloaded plan purchased on our website because your phone is carrier-locked: refunds for “carrier-locked” devices (or “(e)SIM-locked”) are not possible. It is mentioned within the cart that you need to confirm that your device is carrier-unlocked. In the case that your phone is carrier-locked, please note that you can contact the operator from whom you purchased your device and request it to be “unlocked”.
Note: The preloaded eSIM data plans in the form of QR codes remain valid for 6 months from the date of purchase.
For a top up purchased on your Mozillion account: If you have recharged your existing account, the purchased data plans cannot be refunded if you have started using the service.
In case of proven technical issues to activate the Services due to Mozillion, a possible refund is available starting from the occurrence of the problem.
The replacement of data plans or their transfer to other Mozillion accounts is not possible. To initiate a refund request, please reach out to the customer service team and attach the payment confirmation within 14 business days from the date of purchase (or the occurrence of the technical issue with the Services). Upon receipt, you will receive an acknowledgment of your request, and the refund will be processed within 10 business days through the original payment method used during the purchase.
Indemnity
In compliance with applicable laws, You agree, at your sole cost and expense, to fully defend, indemnify and hold harmless Mozillion Limited , its affiliates, subsidiaries, shareholders, directors, officers, employees, and agents from and against any and all claims, causes of action, actions, judgments, liabilities and/or damages (including without limitation reasonable expenses and reasonable attorney’s fees) arising out of or in connection with (i) your use of the Service, (ii) your Account (including the use of your Account by a third party) and (iii) this Agreement.
Limitation of Liability
EXCEPT FOR DAMAGES CAUSED BY OUR INTENTIONAL MISCONDUCT, WE WILL NOT BE LIABLE FOR DAMAGES THAT EXCEED THE AMOUNT OF OUR CHARGES TO YOU FOR YOUR ACTUAL USE OF THE SERVICE DURING THE PRIOR ONE-MONTH PERIOD. UNDER NO CIRCUMSTANCES WILL WE BE LIABLE FOR ANY DIRECT, SPECIAL, CONSEQUENTIAL, INCIDENTAL, INDIRECT, EXEMPLARY OR PUNITIVE DAMAGES, INCLUDING, BUT NOT LIMITED TO, LOSS OF PROFIT OR REVENUES, OR INCREASED COSTS OF OPERATION, EVEN IF SUCH DAMAGES WERE FORESEEABLE OR WE HAVE BEEN SPECIFICALLY ADVISED OF THE POSSIBILITY OF SUCH DAMAGES, AND NO MATTER HOW THAT CLAIM IS STYLED OR ON WHAT LEGAL GROUNDS IT IS BASED (SUCH AS CONTRACT, TORT, STATUTE OR OTHERWISE).
No Warranties
WE DO NOT MAKE ANY WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION ANY WARRANTIES OF TITLE, NON-INFRINGEMENT OF INTELLECTUAL PROPERTY, MERCHANTABILITY, TECHNICAL COMPATIBILITY OR FITNESS FOR A PARTICULAR PURPOSE WITH REGARD TO ANY SERVICE, PRODUCTS OR MATERIAL PROVIDED PURSUANT TO THIS AGREEMENT AND ON THIS WEBSITE. WE ALSO MAKE NO WARRANTY THAT THE SERVICE WILL BE UNINTERRUPTED OR ERROR FREE. WE DO NOT AUTHORIZE ANYONE, INCLUDING OUR EMPLOYEES, AGENTS OR REPRESENTATIVES, TO MAKE A WARRANTY OF ANY KIND ON OUR BEHALF AND YOU SHOULD NOT RELY ON ANY SUCH WARRANTY. YOU EXPRESSLY ACKNOWLEDGE AND AGREE THAT BECAUSE THE SERVICE IS PROVIDED IN PART OVER NETWORKS OUTSIDE OF OUR CONTROL, THEY ARE SUBJECT TO OUTAGES, DISRUPTIONS AND INTERCEPTION, AND THAT WE HAVE NO LIABILITY FOR ANY SUCH OUTAGES, DISRUPTIONS OR INTERCEPTIONS. MOZILLION IS NOT RESPONSIBLE FOR THE CONTENT OF COMMUNICATIONS TRANSMITTED THROUGH THE SERVICE.

Trademarks
All corporate names, service marks, logos, trade names, trademarks, websites and domain names of Mozillion Ltd, (collectively, “Marks”) are and shall remain the exclusive property of Mozillion and nothing in this Agreement shall grant You the license to use such Marks without our prior written permission.
Assignment
We may assign all or part of our rights and duties under this Agreement to any party at any time without notice to You. If we do that, we will have no further obligation to You in connection with such assigned duty. You may not assign your rights and duties under this Agreement without our prior written permission.
Severability
If any provision of this Agreement is held to be invalid, illegal or unenforceable, the remaining provisions of this Agreement will continue in full force and effect.
Integration – Entire Agreement
This Agreement, together with any written amendments or written modifications, will constitute the entire Agreement between You and Mozillion Ltd with respect to the Service and will supersede and replace all prior or contemporaneous understandings or agreements, written, electronic or oral, between You and Mozillion Ltd. No written or oral statement, advertisement or service description not expressly contained in the Agreement will be allowed to contradict, explain, modify or supplement it. You acknowledge and agree that You are not relying on any representation or statement by Mozillion Ltd that is not included in this Agreement.
Force Majeure
Mozillion Ltd shall not be held responsible for any delay or failure in performance of any part of this Agreement to the extent that such delay or failure is caused by fire, flood, explosion, war, embargo, government requirement, civil or military authority, act of God or other similar causes beyond Mozillion’s control.
No Waivers
Mozillion’s failure to exercise any of its rights hereunder upon breach by Customer or pursuant to any condition, covenant or provision contained in this Agreement shall not be construed as a waiver thereof, nor as a waiver of the same or any other default subsequently occurring.
Governing Law
Unless provided otherwise in applicable laws, You are subject to English laws and any disputes will be settled in the courts of the England and Wales, Scotland or Northern Ireland as applicable.
